Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Tailwind Scholarships website at tailwindscholarships.com and all related services (collectively, the “Service”) provided by Tailwind Scholarships (“we,” “us,” or “our”).

Please read these Terms carefully before using the Service. By creating an account, subscribing, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference.

If you do not agree to these Terms, do not use the Service.

Plain English summary Tailwind Scholarships provides a personalized aviation scholarship matching service. You pay an annual subscription fee, we match you to scholarships you qualify for, and we send you deadline alerts. We do our best to keep the database accurate, but we cannot guarantee scholarship outcomes. These terms set out what you can expect from us and what we expect from you.

1. Eligibility

To use the Service, you must:

Be at least 16 years of age. Users aged 16 or 17 should obtain parental or guardian consent before subscribing.
Be a legal resident of the United States or be enrolled in flight training at a U.S.-based institution
Provide accurate and complete information when creating your account and completing your profile
Have the legal capacity to enter into a binding contract. If you are under 18, your parent or guardian must agree to these Terms on your behalf.

We reserve the right to refuse access to the Service to any person at our discretion.

2. Account registration and security

To access the Service, you must create an account and complete your eligibility profile. You agree to:

Provide accurate, current, and complete information at the time of registration and keep it up to date
Maintain the security of your account credentials and not share your password with any third party
Notify us immediately at crew@tailwindscholarships.com if you suspect unauthorised access to your account
Accept responsibility for all activity that occurs under your account

We are not liable for any loss or damage arising from your failure to maintain account security. We may suspend or terminate accounts that we reasonably believe have been compromised or are being misused.

3. Subscription and payment

3.1 Subscription plans

The Service is available on an annual subscription basis. Current plans are:

Standard — $79 per year. Full access to the matched scholarship database, monthly deadline alerts, and Help Me Prepare checklists.
Plus — $149 per year. Everything in Standard, plus 48-hour early access to new scholarships, AI-powered personal statement drafts (3 per month), and 2 application reviews per year.

We reserve the right to change subscription prices at any time. Any price change will take effect at the start of your next billing cycle. We will notify you by email no fewer than 30 days before any price change takes effect. Continued use of the Service after the price change constitutes your agreement to pay the new price.

3.2 Billing and renewal

Subscriptions are billed annually in advance. Your subscription will automatically renew at the end of each annual period unless you cancel before the renewal date. You authorise us to charge your payment method on file for each renewal period.

Payment is processed by Stripe. By subscribing, you agree to Stripe’s terms of service. We do not store your full payment card details.

3.3 Refund policy

We offer a 14-day refund from the date of your initial subscription or renewal if you are not satisfied with the Service. To request a refund, contact us at crew@tailwindscholarships.com within 14 days of your billing date. Refunds are issued to the original payment method and may take 5–10 business days to appear.

Refunds are not available after the 14-day window, for partial subscription periods, or for accounts that have been terminated for a breach of these Terms.

3.4 Cancellation

You may cancel your subscription at any time from your account settings or by contacting crew@tailwindscholarships.com. Cancellation takes effect at the end of your current billing period. You will retain full access to the Service until that date. We do not offer pro-rated refunds for cancellations made after the 14-day refund window.

4. The Service — what we provide

4.1 Scholarship matching

Tailwind Scholarships maintains a database of aviation scholarships and uses your eligibility profile to identify scholarships you may qualify for. Your matched list is based on the information you provide and is refreshed monthly.

We make reasonable efforts to ensure the accuracy of scholarship information in our database, including eligibility requirements, award amounts, deadlines, and application URLs. However, scholarship details can change, and we cannot guarantee that all information is current or complete at any given time. You are responsible for verifying all scholarship details directly with the sponsoring organisation before applying.

4.2 Deadline alerts

We send monthly digest emails and deadline alert notifications based on your saved and matched scholarships. Alerts are sent as a convenience and are not a guarantee that all relevant deadlines will be communicated. You remain responsible for tracking application deadlines independently.

4.3 Plus tier features

Plus subscribers receive additional features subject to the following conditions:

AI personal statement drafts are generated using your profile and the relevant scholarship criteria. They are provided as a starting point only. You are responsible for reviewing, editing, and personalizing any draft before submitting it as part of a scholarship application. Submitting AI-generated content without disclosure may violate individual scholarship rules — check the requirements of each scholarship before submitting.
Application reviews are written feedback provided by Tailwind Scholarships staff based on our experience with scholarship applications. They are not professional legal, educational, or career advice. Two review credits are available per subscription year and do not roll over to the following year.
Early access gives Plus members 48 hours of advance access to newly added scholarships before Standard members see them.

4.4 Service availability

We aim to make the Service available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

5. Acceptable use

You agree to use the Service only for its intended purpose of finding aviation scholarships for your own flight training. You must not:

Share your account credentials or allow others to access the Service using your account
Scrape, copy, redistribute, or resell any part of the scholarship database or Service content
Use the Service for any commercial purpose other than applying for scholarships for your own training
Attempt to gain unauthorised access to any part of the Service or its underlying systems
Submit false or misleading information in your profile to manipulate your scholarship matches
Use the Service in any way that violates applicable law or regulation
Interfere with or disrupt the Service or its servers or networks

We reserve the right to suspend or terminate your account without notice if we determine you have violated these acceptable use requirements. No refund will be issued in the case of termination for breach.

6. Intellectual property

6.1 Our content

The Service, including the website, database, software, text, design, logos, and all other content, is owned by or licensed to Tailwind Scholarships and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.

You are permitted to use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our prior written consent.

6.2 Scholarship content

The scholarship information in our database is sourced from publicly available information published by scholarship sponsors. We do not claim ownership of that information and do not represent any of the sponsoring organisations. Links to external scholarship websites are provided for your convenience and do not constitute an endorsement.

6.3 Your content

Any information you submit to the Service — including your profile data and any communications with us — remains yours. You grant us a limited licence to use that information to operate and improve the Service as described in our Privacy Policy.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically, we do not warrant or guarantee:

That the scholarship information in our database is accurate, complete, or current at any given time
That you will be matched to any specific number of scholarships
That any scholarship you apply for through the Service will result in an award
That deadline alerts will be received in time for you to apply
That AI-generated personal statement drafts will be suitable for submission without editing
That the Service will be uninterrupted, error-free, or free of viruses or other harmful components

Tailwind Scholarships is a scholarship discovery and matching tool. We are not affiliated with any scholarship sponsor, and we do not participate in or influence scholarship award decisions. Scholarship outcomes depend entirely on the criteria and decisions of the sponsoring organisations.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TAILWIND SCHOLARSHIPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR LOSS OF SCHOLARSHIP OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tailwind Scholarships and its officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content or information you submit to the Service.

10. Third-party services and links

The Service integrates with and links to third-party services including Stripe (payments), Memberstack (authentication), Mailchimp (email delivery), Google Analytics (analytics), Facebook (social media), Airtable (database), and Webflow (website). Your use of those services is governed by their respective terms of service and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.

Scholarship application portals and sponsoring organisation websites linked from our database are operated by third parties. We are not responsible for their content, availability, or the outcome of any applications submitted through those portals.

11. Modifications to the Service and Terms

11.1 Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you for any modification, suspension, or discontinuation of the Service, except that if we discontinue the Service entirely, we will provide pro-rated refunds for any remaining subscription period.

11.2 Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and by posting a prominent notice on tailwindscholarships.com no fewer than 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.

12. Termination

Either party may terminate this agreement at any time. You may terminate by cancelling your subscription (Section 3.4). We may terminate your account immediately and without notice if:

You breach any provision of these Terms
We are required to do so by law
We determine that continuing to provide the Service to you would expose us or others to harm or legal liability

Upon termination, your right to access the Service ceases immediately. Sections 6, 7, 8, 9, 13, and 14 of these Terms survive termination.

13. Governing law and dispute resolution

13.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

13.2 Informal resolution

Before initiating any formal dispute process, you agree to contact us at crew@tailwindscholarships.com to attempt to resolve the dispute informally. We will endeavour to resolve the dispute within 30 days of receiving your written notice.

13.3 Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, conducted in the State of New York. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and Tailwind Scholarships each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

13.4 Small claims

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court’s jurisdiction.

14. General provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tailwind Scholarships regarding the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force majeure. We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, government action, or internet outages.
Notices. We will provide notices to you by email at the address associated with your account. You may provide notices to us at crew@tailwindscholarships.com.
